Proposed 5th Amendment

A fifth amendment to the Gates Creek Convenants, Conditions, and Rules (CC&Rs) has been proposed to remedy issues arising from exceptions granted by the developer. The fifth amendment is recommended by all current members of the board of directors.

The amendment contains two changes to the existing covenants: (1) removes the definition of a hot tub as a swimming pool; and (2) adds material types for resident fencing.

Our current CC&Rs, Article VII, Section 3, define "Hot Tubs" as swimming pools and therefore must be installed in-ground. The developer allowed an exception to this rule, but the Board does not have the authority to approve. Similarly, Article VII, Section 10 requires cedar wood only for fences and exceptions were granted by the developer to allow other materials to be used for fencing. 

The Board is acting on the recommendations of the Associations' attorneys to amend the existing CC&R's.
